These Terms of Service ("Terms") govern your access to and use of the website, content, newsletters, downloads, digital products, and related services (together, the "Site"). The Mom Fund is a brand operated by TMF Ventures LLC ("TMF Ventures LLC," "The Mom Fund," "we," "us," or "our"). By accessing or using the Site, or by purchasing any product from us, you agree to these Terms. If you do not agree, please do not use the Site or purchase our products.

1. Eligibility

You must be at least 18 years old to use the Site, subscribe to our newsletter, or purchase our products. The Site is intended for adults. We do not knowingly collect information from anyone under the age of 13, and no part of the Site is directed to children under 13. If you believe a child has provided us information, contact us at hello@themomfund.com and we will delete it.

2. Use of the Site

The Site and its content are provided for informational, educational, and inspirational purposes. You agree to use the Site lawfully and not to disrupt, misuse, or attempt to gain unauthorized access to it. You may not reproduce, distribute, or republish any content without our prior written permission.

3. Intellectual Property

All content on the Site, including text, graphics, logos, prompts, systems, templates, product names, and visuals, is the property of TMF Ventures LLC or its licensors and is protected by U.S. copyright and trademark law. Unauthorized use is prohibited. Additional terms governing our prompts and downloadable tools appear in our AI Tools & Prompt Usage Policy.

4. User Submissions

Any comments, feedback, or ideas you submit may be used by us for editorial or promotional purposes without obligation to you, with credit where appropriate. Do not submit anything you do not have the right to share.

5. Digital Products

We sell digital products, including The Collection, The Camera Roll, bundles of those products, and any future editions, drops, or parts we release (each a "Product"). Products consist of written prompts, systems, instructions, and related materials that you use inside third-party AI tools such as ChatGPT, Claude, or Gemini. Products are delivered digitally. Nothing physical ships.

By purchasing a Product you receive a limited, personal, non-transferable, non-commercial license to use it within your own household. You may not resell, share, publish, redistribute, or give away a Product or any part of it, share or post the access link or access page, use a Product to create a competing product, or remove any notice of ownership. Access links are for you alone. We may suspend or revoke access, without refund, if a Product or access link is shared or misused.

The price, contents, and description of each Product are those presented at the point of sale on the day you buy. We may change prices, run promotions, add to or revise a Product, or stop selling a Product at any time. Promotional pricing and "compare at" figures are for illustration only and are not a promise of value or savings.

6. Delivery and Access

Access is provided on the order confirmation page and by email to the address used at checkout, normally within minutes of payment. It is your responsibility to enter a correct email address and to check your spam folder. If you cannot find or open your Product within 48 hours of purchase, email hello@themomfund.com with your order number and we will restore access.

Where a Product is described as "yours forever," "lifetime," or similar, that means access for as long as we operate the Product, at no additional charge. If we ever discontinue a Product or the Site, we will make reasonable efforts to give you notice and a way to save your materials. We may update, reorganize, rename, or expand a Product over time, and the version you have access to may differ from the version described when you bought it.

Where a Product page describes future content, such as a future drop, part, or edition "included" with a purchase, that content is provided as a bonus at our discretion. We will make good-faith efforts to deliver it, but its timing, scope, and contents may change, and it does not form part of the paid Product for refund purposes.

7. All Sales Final

Our Products are digital and delivered instantly, so they cannot be returned. All sales are final. We do not offer refunds, exchanges, or credits for any reason, including change of mind, purchases made in error, dissatisfaction with the content, or not using the Product, except in the two cases below and where a refund is required by applicable law.

Duplicate purchase. If you accidentally buy the same Product twice, or buy a Product that is already included in a bundle you own, email hello@themomfund.com within 7 days of the duplicate order with both order numbers and we will refund the duplicate.

Access not delivered. If you cannot access a Product and we are unable to restore access after you contact us as described in Section 6, we will refund that purchase.

Please contact us before disputing any charge. Initiating a chargeback rather than contacting us first is a violation of these Terms and may result in loss of access to all of your Products.

8. Third-Party AI Tools and Outputs

Our Products are designed to be used with third-party AI tools that we do not own, operate, or control. Your use of those tools is governed by their terms, privacy policies, pricing, and availability, not ours. You are responsible for your own AI accounts and for anything you enter into them, including photos, documents, and personal or family information. We do not receive, store, or see what you enter into a third-party AI tool.

The output of an AI tool is generated by that tool, not by us. AI output can be inaccurate, incomplete, out of date, or wrong. We do not review, endorse, or guarantee any output, and we are not responsible for any decision you make or action you take based on it. Always verify important details such as dates, deadlines, dosages, prices, coverage, and legal or financial figures with a reliable source before relying on them.

9. No Professional Advice; No Guarantee of Results

Our Products, prompts, systems, and content, and any AI output produced with them, are for general informational and organizational purposes only. They are not, and should not be treated as, financial, investment, tax, insurance, benefits, legal, medical, nutritional, or other professional advice, and they do not create any professional relationship. Consult a qualified professional before making decisions in those areas. Any examples of time saved, money saved, cost comparisons, or results are illustrative only. 10. Third-Party Links

The Site may link to third-party websites, tools, or platforms, and some links may be affiliate links. We do not control and are not responsible for the content, policies, or practices of those third parties. Accessing them is at your own risk.

11. Disclaimer of Warranties

The Site, all content, and all Products are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site or any Product will be uninterrupted, error-free, or free of harmful components, that any content or AI output is accurate, complete, or current, or that any Product will meet your needs or produce any particular result.

12. Limitation of Liability

To the fullest extent permitted by law, TMF Ventures LLC and its owners, employees, contractors, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of data, profits, savings, opportunity, or goodwill, arising from your use of or inability to use the Site or any Product, from any AI output, or from reliance on any content. Where liability cannot be excluded, our total liability to you for all claims will not exceed the greater of the amount you paid us in the twelve months before the claim arose or one hundred U.S. dollars ($100).

13. Indemnification

You agree to indemnify and hold harmless TMF Ventures LLC and its owners and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site or any Product, anything you submit to a third-party AI tool, your violation of these Terms, or your violation of any law or third-party right.

14. Termination

We may suspend or terminate your access to the Site or any Product at any time, without notice, if you violate these Terms or misuse the Site or a Product. Sections 3, 5, and 7 through 16 survive termination.

15. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted. Your continued use of the Site or any Product after changes are posted means you accept the updated Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising from these Terms, your use of the Site, or any Product will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction. You agree to bring any claim individually and not as part of a class or representative action. Before filing any claim, you agree to contact us at hello@themomfund.com and give us 30 days to try to resolve it.
